This Card is subject to the Bank’s Current Account Opening Agreement for Individuals in addition to the terms and conditions of this Agreement. In case of any conflict between the terms and conditions of this Agreement and the Bank’s Current Account Opening Agreement for Individuals, the provisions of this Agreement shall prevail.
Bank or First Party: D360 Bank, a Saudi joint-stock company with a capital of 2,100,000,000 SR and commercial registration number 1010822737, licensed according to the Council of Ministers’ decree No. 389 dated 14/07/1443 A.H., corresponding to 15/02/2022 A.C., and subject to the supervision and control of the Saudi Central Bank.
Ehsan Card or Card: A prepaid card issued by the Bank in the name of the Customer based on their request and the Bank’s approval, in accordance with the policies of the Bank and regulatory authorities. The Customer can load the Card with the desired amount, and it can be used inside and outside the Kingdom via Visa or MasterCard at ATMs, stores, restaurants, or online. The Ehsan Card includes a charitable donation feature whereby a percentage of the Bank’s profitability from Eligible Transactions (as defined below) is donated to Ehsan on behalf of the Cardholder.
Bank Application: The Bank’s Application, which can be downloaded on smart devices to access the banking services provided by the Bank.
Cardholder: The Customer who applied for the Card through the Bank. The Card is issued in the name of the Cardholder, who is legally responsible for all obligations arising from its use. This individual is referred to as the “Customer” in this Agreement.
Card Limit: The limit deposited by the Customer in the Card issued in the name of the Cardholder, according to these terms and conditions.
Cash Withdrawal: The amount withdrawn by the Cardholder from the Card’s Account via ATM, not exceeding five thousand Saudi Riyals per day, subject to the withdrawal controls issued by the Bank or regulatory authorities.
Ehsan: The National Charitable Platform operating in the Kingdom of Saudi Arabia, or any other charitable organization designated by the Bank from time to time.
Eligible Transactions: Card transactions that qualify for the charitable donation feature under this Agreement. Eligible Transactions include Point of Sale (POS) purchases and e-commerce transactions that are successfully completed and not subsequently reversed, refunded, or canceled, excluding Excluded Transactions.
Excluded Transactions: Transactions that do not qualify for the charitable donation feature, including but not limited to: (a) Cash withdrawals from ATMs; (b) Funds transfers to current accounts or electronic wallets; (c) Reversals, refunds, or cancellations of POS or e-commerce transactions; (d) Transactions at gas stations; (e) Utility payments; (f) Government payments; (g) ATM transactions; (h) SADAD payments; and (i) E-wallet transactions.
Household Member: Family member (e.g., wife, son, daughter) of the individual householder or anyone who has a direct legal relationship with the individual householder (e.g., legal guardian).
Agreement: These terms and conditions for the Ehsan Card.
Unless otherwise stated, all terms defined in this Agreement shall have the same meaning as in the Bank’s Current Account Opening Agreement for Individuals.
3. The Bank operates the Ehsan Card with a charitable donation feature, whereby the Bank contributes a 0.5% of the transaction amount derived from Eligible Transactions to Ehsan on behalf of the Cardholder.
4. The donation will be performed by the Bank on behalf of the Customer based on the transaction amount from the card spend and Eligible Transactions only. The specific donation percentage shall be determined by the Bank and may be communicated to Cardholders through the Bank’s official communication channels.
5. The charitable donation is made by the Bank on behalf of the Cardholder and does not constitute a deduction from the Customer’s Card balance or account. The donation is funded entirely by the Bank.
6. Only Eligible Transactions qualify for the charitable donation feature. Excluded Transactions, as defined in this Agreement, do not contribute to the calculation of donations under the Ehsan Card program.
7. The following transactions are specifically excluded from the Ehsan charitable donation calculation:
a. Cash withdrawals from ATMs;
b. Fund transfers to current accounts or electronic wallets;
c. Reversals of POS or e-commerce transactions, or transactions that have been refunded or canceled;
d. Transactions at gas stations;
e. Utility payments;
f. Government payments;
g. ATM transactions;
h. SADAD payments;
i. Transfers;
j. Auto dealers; and
k. Transactions amounting to SAR 2 or below.
8. The Bank reserves the right to modify, suspend, or terminate the Ehsan charitable donation program at any time, with prior notice to Cardholders in accordance with the notice provisions set forth in this Agreement.
9. The Customer acknowledges and agrees that the Bank has sole discretion in determining the charitable beneficiary, the calculation methodology for donations, and the timing and manner of making donations to Ehsan.
10. The Bank may, from time to time, provide statements or reports to Cardholders regarding the aggregate donations made under the Ehsan Card program, but is under no obligation to provide individual Cardholder-specific donation calculations.
11. If the Card is cancelled by the Customer while there are pending transactions for which a donation has been calculated, the Bank will not be liable if the transaction is reversed after the Card’s cancellation date.
12. In full compliance with applicable laws and regulations, the Bank has the right to use the personal information provided by the Customer, such as email, ID or residency number, phone numbers, etc., for banking purposes.
13. If the Customer does not collect the plastic Card, the Bank has the right to destroy it within 60 days.
14. The Bank retains all Customer documents for a period not less than ten years.
15. All funds and securities held by the Bank for the Customer are considered collateral and security for the Customer, and the Bank has the right to settle its dues directly without recourse to the Customer.
16. The Bank has the right, at its sole discretion, to suspend the Card in the following cases:
a. If it appears that the Customer’s Card was used by an unauthorized person;
b. There is insufficient balance on the annual fee due date, if applicable;
c. If the Customer, or any of their authorized representatives, violates any of the terms and conditions of this Agreement or any of the Bank’s policies;
d. Customer’s death; or
e. If the Account is subject to identity verification or compliance with jurisdiction or banking regulations, or if the Customer fails to provide the necessary documents upon the Bank’s request.
17. The Customer acknowledges that they are 18 years old or older.
18. The Customer obtains the Physical Card upon request only, and the Card is activated through the Bank’s Application.
19. The Customer is obligated to pay all applicable fees on the Card under this Agreement, which are part of the Bank’s financial dues that the Customer must fulfill. If the Customer fails to comply, the Bank has the right to suspend their services.
20. The Customer must maintain an active account with the Bank to be eligible for a Card.
21. The Customer has the right to obtain more than one Card, not exceeding five Cards or any other number for all their Accounts within the Bank in accordance with the Bank’s policies.
22. The Customer has the right to purchase with the Card up to a maximum of twenty thousand Saudi Riyals daily, with the possibility of increasing the limit to two hundred thousand Saudi Riyals in accordance with the Bank’s policies and the regulatory authorities. The Customer can control the daily purchase limit through the Bank’s Application.
23. The Customer has the right to transfer funds from the Card to their Account with the Bank.
24. The Customer bears all consequences of using the Card, whether for cash withdrawal, purchase, or any other transaction, whether directly or indirectly through the Card, and the Customer is fully responsible for all uses and obligations arising from the use of the Card.
25. If the Customer wishes to obtain any funds via an international ATM, certain fees will be deducted from each international cash withdrawal, in addition to service fees calculated from the withdrawal date.
26. The Customer must comply with paying the Bank’s dues for transactions in accordance with Table No. 1 (Fees) attached hereto and available on the Bank’s website, as updated from time to time.
27. In case of default in payment, the Customer must fulfill their obligations within 30 days from the date of receiving the Bank’s notice.
28. The Customer acknowledges that their relationship with the Bank is entirely independent of their relationship with any other party, and the Bank is not responsible for the Card’s acceptance or rejection.
29. The Customer must maintain the Card and its PIN in full confidence and not disclose it or share it with anyone.
30. The Card is prohibited from being used to purchase goods and services forbidden by Shariah. If it is found that the Customer used the Card to purchase such goods or services, the Bank has the right, at its sole discretion, to suspend the transaction and/or cancel the Card, in addition to taking any measures the Bank deems appropriate.
31. The Customer must update their personal data related to the Card to avoid any service interruption due to non-compliance.
32. In case of loss, theft, or damage to the plastic Card, the Customer must immediately suspend the Card through the Bank’s Application. The Bank is not obligated to compensate the Customer for such cases but the Customer has the right to request a replacement Card for a fee imposed by the Bank, if applicable.
33. The Customer has the right to dispute any purchase transaction within 30 days from the transaction date, provided that the Bank is supplied with all supporting documents.
34. The Customer must notify the Bank through the Bank’s Application if they do not wish to renew the Card.
35. If the Customer wishes to cancel the card, they must notify the Bank through the Bank’s Application. In case there is a balance remaining on the card, the Customer has the right to choose any of their personal accounts with the Bank to transfer the remaining balance.
36. The Customer acknowledges paying any VAT on fees, services, and goods according to the regulations of the Kingdom of Saudi Arabia.
37. The Customer acknowledges that the Card shall expire within five (5) years from the date of issuance.
38. The Customer acknowledges that the Bank has the right to amend this Agreement, including, but not limited to, the fees, provided that the Bank notifies the Customer through the Bank’s official communication channels at least 30 days before the effective date, excluding any promotional fee reductions. If the Customer objects and does not accept, the Customer has the right to cancel the Card within 14 days from the date of receiving the change notice, and in this case, the Customer has the right to request the fees covering the remaining period. The Customer can view the fee schedule through the Bank’s website.
If an individual householder is the contracting entity under this Agreement, such individual shall be treated as the “Customer”, and the following shall apply:
39. Know Your Customer (KYC), Anti-Money Laundering and Counter-Terrorist Financing and any other related laws and regulations shall apply to the individual householder, and the Cardholder shall not be subject to any KYC. A master account shall be opened under the name of the individual householder which is directly related to the bank account of the householder.
40. Electronic record or ‘sub-records’ (sub-accounts of the master account) shall be opened for every payment service product issued.
41. Sub-records’ (card accounts) shall not be allowed to accept cash deposits or any credit entries other than the amounts transferred thereto from the master account of the householder.
42. No monthly statements shall be required for issue for such sub-record Customers (cardholders) unless specifically requested by the householder. Instead, the cardholder can get an ATM-generated brief transaction statement.
43. The individual householder shall remain liable and responsible for all transactions effected by the cardholder as evidenced through the sub-record.
44. The householder has to provide the Bank with complete and accurate application details and the National Identification Number for cardholders.
45. Transactions under Ehsan Prepaid Card shall be limited to:
a. Domestic withdrawals (via ATM and PoS purchase);
b. International transactions;
c. Provisioning the Card to mobile wallets;
d. POS purchase; and
e. Transfers to and from the prepaid payment service record to the contracting entity’s own current account.
46. The Bank will issue cards (if requested by the householder) and personal identification numbers (PIN’s) to the individual householder for delivery to cardholders (e.g., Household Members).
47. In case of any legal changes of the legal relationship between the householder and any Household Member, the individual householder shall inform the Bank and the Card (as the case may be) shall be canceled.
48. If any part of this Agreement is deemed invalid or unenforceable in any respect, it shall be deleted and the remaining provisions of the Agreement shall remain valid and enforceable.
49. Notices between the parties shall be exchanged through approved communication means (i.e., the application, phone number, or email).
50. This Agreement shall be governed by and interpreted in accordance with the laws of the Kingdom of Saudi Arabia. Any disputes arising from or related to this Agreement that cannot be settled amicably shall be finally resolved by the competent authority.
51. This Agreement is drafted in both Arabic and English. In case of any conflict between the two languages, the Arabic version shall prevail.
