D360 Bank Prepaid Card Agreement Terms and Conditions 

 

This Card is subject to the Bank’s Current Account Opening Agreement for Individuals in addition to the terms and conditions of this Agreement. In case of any conflict between the terms and conditions of this Agreement and the Bank’s Current Account Opening Agreement for Individuals, the provisions of this Agreement shall prevail.

1.     Definitions and Interpretations

1.1   In this Agreement, the following words and phrases have the definitions specified below:

Card: A prepaid card issued by the Bank in the name of the Customer based on their request and the Bank’s approval, in accordance with the policies of the Bank and regulatory authorities. The Customer can load the Card with the desired amount, and it can be used inside and outside the Kingdom via Visa or MasterCard at ATMs, stores, restaurants, or online.

Bank Application: The Bank’s Application, which can be downloaded on smart devices to access the banking services provided by the Bank.

Cardholder: The Customer who applied for the Card through the Bank. The Card is issued in the name of the Cardholder, who is legally responsible for all obligations arising from its use. This individual is referred to as the “Customer” in this Agreement.

Card Limit: The limit deposited by the Customer in the Card issued in the name of the Cardholder, according to these terms and conditions.

Cash Withdrawal: The amount withdrawn by the Cardholder from the Card’s Account via ATM, not exceeding five thousand Saudi Riyals per day, subject to the withdrawal controls issued by the Bank or regulatory authorities.

Household Member: family member (e.g. wife, son, daughter) of the individual householder or anyone who has direct a legal relationship with the individual householder (e.g. legal guardian).

Agreement: These terms and conditions for the Card.

1.2   In this Agreement:

(a)      where there is a reference to a document or policy made available on D360 Bank’s application, such document or policy, as amended from time to time, shall be a part of this Agreement. D360 Bank shall notify the Customer 30 days in advance prior their effective date. The continued use of D360 Bank’s products and services following an amendment shall constitute acceptance of such amendment.

(b)     Unless otherwise stated, all terms defined in this Agreement shall have the same meaning as in the Bank’s Current Account Opening Agreement for Individuals.

2.     Bank’s Rights and Obligations

2.1    The Bank shall have the right to maintain the confidentiality of all data and information provided by the Customer, except for disclosures made by the Bank for specific professional or operational purposes — after obtaining the Customer’s consent — or to competent government authorities in accordance with applicable laws and regulations.

2.2  The Bank may send text messages, make phone calls, or deliver marketing materials to the Customer regarding the Bank’s products and services, unless the Customer expresses unwillingness to receive such messages or marketing materials.

2.3   If the Customer does not collect the plastic Card, the Bank has the right to destroy it within 60 days.

2.4   The Bank may retain all documents related to the Customer’s Card in electronic records, files, or by any internationally recognized document imaging methods for a minimum period of ten (10) years from the date of termination of this Agreement. The Bank shall also have the right to continue archiving such data and documents in accordance with the applicable regulatory requirements..

2.5   The Bank has the right, at its sole discretion, to suspend the Card in the following cases:

(a)        if it appears that the Customer’s Card was used by an unauthorized person.

(b)       if the Customer, or any of their authorized representatives, violates any of the terms and conditions of this Agreement or any of the Bank’s policies.

(c)        Customer’s death.

(d)       if the Account is subject to identity verification or compliance with jurisdiction or banking regulations, or if the Customer fails to provide the necessary documents upon the Bank’s request.

3.     Customer’s Rights and Obligations

3.1   The Customer acknowledges that they are 18 years old or older.

3.2   The Customer obtains the Card upon request only, and the Card is activated through the Bank’s Application.

3.3   The card issuance fee shall be deducted from the Card Account on the issuance date following activation. In the event the Cardholder requests a replacement due to loss or damage, a replacement card issuance fee will be applied.

3.4  All fees due to the Bank from the Cardholder, such as issuance and withdrawal fees, shall be deducted from the Cardholder’s current account with the Bank or from the Card Account.

3.5  The Customer must maintain an active account with the Bank to be eligible for a Card.

3.6   The Customer has the right to obtain more than one Card, not exceeding five Cards or any other number for all their Accounts within the Bank in accordance with the Bank’s policies.

3.7  The Customer has the right to purchase with the Card up to a maximum of twenty thousand Saudi Riyals daily, with the possibility of increasing the limit to two hundred thousand Saudi Riyals in accordance with the Bank’s policies and the regulatory authorities. The Customer can control the daily purchase limit through the Bank’s Application.

3.8   The Customer has the right to transfer funds from the Card to their Account with the Bank.

3.9   The Customer bears all consequences of using the Card, whether for cash withdrawal, purchase, or any other transaction, whether directly or indirectly through the Card, and the Customer is fully responsible for all uses and obligations arising from the use of the Card.

3.10         If the Customer wishes to obtain any funds via international ATM, certain fees will be deducted from each international cash withdrawal, in addition to service fees calculated from the withdrawal date.

3.11    The Customer must comply with paying the Bank’s dues for transactions in accordance with Table No.1 (Fees) attached hereto and available on the Bank’s website, as updated from time to time.

3.12    In case of default in payment, the Customer must fulfill their obligations within 30 days from the date of receiving the Bank’s notice.

3.13    The Customer acknowledges that their relationship with the Bank is entirely independent of their relationship with any other party, and the Bank is not responsible for the Card’s acceptance or rejection.

3.14    The Customer must maintain the Card and its PIN in full confidence and not disclose it or share it with anyone.

3.15    The Card is prohibited from being used to purchase goods and services forbidden by Shariah. If it is found that the Customer used the Card to purchase such goods or services, the Bank has the right, at its sole discretion, to suspend the transaction and/or cancel the Card, in addition to taking any measures the Bank deems appropriate.

3.16    The Customer must update their personal data related to the Card to avoid any service interruption due to non-compliance.

3.17    In case of loss, theft, or damage to the plastic Card, the Customer must immediately suspend the Card through the Bank’s Application. The Bank is not obligated to compensate the Customer for such cases but the Customer has the right to request a replacement Card for a fee imposed by the Bank, if applicable.

3.18   The Customer has the right to dispute any purchase transaction within 30 days from the transaction date, provided that the Bank is supplied with all supporting documents.

3.19    The Customer must notify the Bank through the Bank’s Application if they do not wish to renew the Card.

3.20   If the customer wishes to cancel the card, they must notify the bank through the bank’s app. In case there is a balance remaining on the card, the customer has the right to choose any of their personal accounts with the bank to transfer the remaining balance

3.21    The Customer acknowledges paying any VAT on fees, services, and goods according to the regulations of the Kingdom of Saudi Arabia.

3.22   The Customer acknowledge that the Card shall expire within five (5) years from the date of issuance.

3.23    The Customer acknowledges that the Bank has the right to amend this Agreement, including, but not limited to, the fees, provided that the Bank notifies the Customer through the Bank’s official communication channels at least 30 days before the effective date, excluding any promotional fee reductions. If the Customer objects and does not accept, the Customer has the right to cancel the Card within 14 days from the date of receiving the change notice, and in this case, the Customer has the right to request the fees covering the remaining period. The Customer can view the fee schedule through the Bank’s website.

 

4.     Individual Householder’s

 

If an individual householder is the contracting entity under this Agreement, such induvial shall be treated as the “Customer”, and the following shall apply:

4.1 Know Your Customer (KYC), Anti-Money laundry and Counter-Terrorist Financing and any other related laws and regulations shall apply to the individual householder, and the Cardholder shall not be subject to any KYC. A master account shall be opened under the name of the individual householder which is directly related to the bank account of the householder.

4.2  Electronic record or ‘sub-records’ (sub-accounts of the master account) shall be opened for every payment service product issued.

4.3  Sub-records’ (card accounts) shall not be allowed to accept cash deposits or any credit entries other than the amounts transferred thereto from the master account of the householder.

4.4  Sub-records credits shall not exceed the maximum purchasing limit for the card.

4.5  No monthly statements shall be required for issue for such sub-record customers (cardholders) unless specifically requested by the householder. Instead, the cardholder can get an ATM-generated brief transaction statement.

4.6  The individual householder shall remain liable and responsible for all transactions effected by the cardholder as evidenced through the sub-record.

4.7  The householder has to provide the Bank with complete and accurate application details and the National Identification Number for cardholders.

4.8  Transactions under Prepaid Card shall be limited to:

(a)   Domestic withdrawals (via ATM and PoS purchase)

(b)    POS purchase

(c)    Transfers to and from the prepaid payment service record to the contracting entity's own current account.

4.9  The Bank will issue cards (if requested by the householder) and personal identification numbers (PIN’s) to the individual householder for delivery to cardholders (e.g. Household Members).

4.10 In case of any legal changes of the legal relationship between the householder and any Household Member, the individual householder, shall inform the Bank and the Crad (as the case may be) shall be canceled.

 

5.     Miscellaneous

5.1   If any part of this Agreement is deemed invalid or unenforceable in any respect, it shall be deleted and the remaining provisions of the Agreement shall remain valid and enforceable.

5.2  Notices between the parties shall be exchanged through approved communication means (i.e., the application, phone number, or email).

5.3   This Agreement shall be governed by and interpreted in accordance with the laws of the Kingdom of Saudi Arabia. Any disputes arising from or related to this Agreement that cannot be settled amicably shall be finally resolved by the competent authority.

5.4   This Agreement is drafted in both Arabic and English. In case of any conflict between the two languages, the Arabic version shall prevail.
